Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the AGOV website, the Area 51 classified archive experience, documentation pages, and any interfaces we provide to interact with smart contracts or third-party networks (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We may modify these Terms at any time. We will update the “Last updated” date when we do. Your continued use after changes constitutes acceptance. If you disagree with changes, stop using the Services.

The Services are provided for informational, experimental, and community purposes. The archive may include summaries and links to third-party sources; we do not warrant the accuracy or completeness of third-party materials. On-chain features (such as presale interactions) execute via your wallet and public smart contracts—not on our servers.

Nothing on the Services is financial, investment, legal, or tax advice. Digital assets are highly volatile and may result in total loss. You are solely responsible for evaluating risks and for compliance with laws in your jurisdiction. Consult qualified professionals before making decisions.

You represent that you are legally permitted to use the Services and to acquire or use digital assets where you reside. You must not use the Services if prohibited by applicable law (including sanctions or securities regulations). You are responsible for determining whether any token purchase or transfer is lawful for you.

• You control your self-custody wallet. We never request your seed phrase or private keys.
• All blockchain transactions are irreversible. Gas fees and failed transactions are your responsibility.
• Smart contracts may contain bugs or be exploited. Interacting with contracts is at your own risk.
• Public blockchains do not guarantee privacy; activity may be traceable.

The Services, including branding, text, graphics, and UI design (excluding third-party or user content), are owned by the project or its licensors. You may not copy, scrape, or redistribute them for commercial use without permission. Third-party trademarks and media remain property of their respective owners.

You agree not to:

• Use the Services for unlawful, fraudulent, or harassing activity.
• Attempt to gain unauthorized access to our systems, other users, or smart contracts beyond intended use.
• Introduce malware, overload infrastructure, or interfere with security.
• Misrepresent affiliation with AGOV or misuse project branding.

The Services may link to or embed third-party websites, videos, or tools. We do not control and are not responsible for third-party content, terms, or privacy practices. Use of third-party services is at your own risk.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE PROJECT, ITS CONTRIBUTORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR BLOCKCHAIN INTERACTIONS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless the project and its contributors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of third-party rights.

These Terms are governed by the laws of the jurisdiction in which the operating entity behind AGOV is organized, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply. Disputes shall be brought in the courts of that jurisdiction unless applicable law requires otherwise.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
